Liability of DAO members in the context of California class-action case :
  • At least in US a legal wrapper seems to be needed to get protection against liability
  • Having the California case in mind the work on a legal wrapper should be intensified
  • Legal wrapper will not reduce the number of cases being started though
  • β€œYou’re not a general partnership until the judge/jury says you are” – food for thought (risk vs reality of proving general partnership in court)
  • Shield for liability does not diminish the risk of being sued, but reduces the risk of being held liable
  • Practical hurdles with suing an individual (identification plus actual possibility of recovery)
  • On-chain insurance (e.g. Nexus Mutual – insurance fund for DeFi)

  • 1 ETH is needed – either to be requested from the grants committee or through crowd funding among the Legal Guild

  • Research on friendly jurisdictions for digital nomads, especially those working in DAOs
